CONCEALED CARRY WEAPON LICENSE

The Burbank Police Department is aware of the recent June 23, 2022, United States Supreme Court ruling in New York State Rifle & Pistol Association v. Bruen, regarding the issuance of public-carry licenses.  The Department is also aware of even more recent action by the California legislature to amend its statutes pertaining to the issuance of a Concealed Carry Weapon (CCW) license.

As a result of the Bruen decision, as well as the forthcoming amendments to California’s CCW statutes, we anticipate an increase in applications for CCW licenses. Changes to our policies and/or procedures will be posted on our website. Our highest priority is public safety and the protection of individual rights.

DEPARTMENT POLICY

Policy 218 - License to Carry a Firearm

 

CONCEALED CARRY WEAPON LICENSE APPLICATION PROCESS

The Chief of Police is given the statutory discretion to issue a license to carry a concealed firearm to residents within the City of Burbank pursuant to Penal Code §26155.  The authority to issue a limited business license to a non-resident applicant is granted only to the Sheriff of the County in which the applicant works pursuant to Penal Code §26150.  The Burbank Police Department (Department) will not issue concealed carry weapon (CCW) licenses to applicants who do not reside in the City of Burbank, even though their principal place of employment is within the city.  The Department will fairly and impartially consider all applicants to carry firearms in accordance with applicable laws and Department policy.

Penal Code section §26175 requires the Attorney General to prescribe a statewide standard application form for a CCW license.

The CCW license application process is the same for all New, Renewal, Modification, and Duplicate licenses. The process includes completing the California Department of Justice (DOJ) Standard Application to Carry a Firearm, Live Scan (electronic fingerprinting), formal interview, training, collection of fees, and in some cases psychological testing may be required.

 

QUALIFIED APPLICANTS

To be approved for a CCW license, the applicant must meet the following requirements pursuant to Penal Codes §26150-§26225:

  • All applicants must provide proof that they are full-time residents of the City of Burbank
  • All applicants must be 21 years of age or older
  • All applicants must submit a completed DOJ Standard Application to Carry a Firearm, which includes substantial personal information (much of the information in the application may be subject to public access under the Public Records Act.)
  • All applicants must provide proof that they are a citizen of the United States (birth certificate, naturalization documents, valid US Passport, valid Permanent Resident Card, or out-of-country Military Birth Certificate)
  • Applicants must be of good moral character concerning their ability to carry and use a concealed weapon responsibly and safely
  • All applicants shall provide fingerprints via Live Scan for a complete background check by the DOJ.  The applicant must be free from criminal convictions that would disqualify them from carrying a firearm.
  • All applicants must be free from any psychological conditions that might make the applicant unsuitable for carrying a firearm
  • All applicants shall provide proof of ownership or registration of any firearm to be licensed
  • Complete required training and weapon qualification. New applicants require a 8-hour course, and renewals require a 4-hour course. (The Department has approved the Los Angeles County Sheriff’s Department Authorized Training Providers, which can be found here: LASD AUTHORIZED TRAINING PROVIDERS).

 

APPLICATION INSTRUCTIONS

YOUR CCW APPLICATION MUST BE SUBMITTED THROUGH OUR ONLINE "Permitium" SYSTEM.

Failure to comply with these instructions may result in a processing delay or cancellation of your application. Applicants must be a full-time resident of the City of Burbank.  Post Office Box addresses are not acceptable as residential addresses. A $20 application fee will be collected at the time the application is submitted.  The payment must be paid via credit card.  

Follow the instructions on the online "Permitium" system, which include the following:

1.  Submit a completed California Department of Justice (DOJ) Standard Application to Carry a Firearm (including sections 7, & 8).  All forms will be signed in the presence of the assigned investigator. 

2.  Once the application has been received and reviewed, the applicant will be required to provide fingerprints via Live Scan to assess the applicant’s eligibility.  An instructional letter and “Request for Live Scan Service” form will be sent.  The “Request for Live Scan” form must be given to the Live Scan service provider, as it includes the necessary routing information that will direct the response to our Department. 

3.  After the applicant’s Live Scan is completed, the results will be sent to our Department and the applicant will be contacted for further instruction. Note: Live Scan results may take between 10-16 weeks to return from the CA DOJ.

4.  Upon completion of the DOJ background, the applicant will be scheduled for an in-person interview and will be required to provide the following documents to the Department:

a) Valid California Driver’s License, or California Identification Card

b) Original Birth Certificate, Naturalization Certificate, or Valid US Passport

c) (2) Proofs of residency in the City of Burbank (utility bills, rental/lease agreement, DMV paperwork, etc.)

d) Military Veterans to provide a DD214 form (discharge document)

e)  Active Military to provide:

·         Home State Driver’s License

·         Military ID

·         Current Station Orders

·         If renting, copy of rental agreement and copies of utility bills

f) Proof of ownership and/or registration of each firearm to be licensed.  The firearm(s) must be registered with the California DOJ.

5.  After the interview, the Chief of Police may require the applicant to be referred to an authorized psychologist used by the Department for psychological testing.  If it is determined that the applicant is not a suitable candidate for carrying a firearm, the applicant shall be removed from further consideration pursuant to Penal Code §26190.

6.  The applicant will be notified to complete a 8-hour course of training approved by the Department to minimally include firearms safety and the laws regarding the permissible use of a firearm.  The course shall comply with Penal Code §26165 and the applicant shall complete a safety and proficiency examination administered by the training provider.    During the 16-hour course of training, the applicant shall submit their firearm(s) for a full safety inspection.  The Department has approved the Los Angeles County Sheriff’s Department Authorized Training Providers, which can be found here: LASD AUTHORIZED TRAINING PROVIDERS

7.  Once the Chief of Police or authorized designee has verified the successful completion of the requirements outlined above, the license to carry a firearm will either be granted or denied. 

 

If an application is denied during any of the above phases, the applicant will be notified in writing with specific reasons why the request was denied pursuant to Penal Code §26205.

Any applicant denied a concealed carry weapon license may appeal the decision to the Chief of Police within 90 calendar days from the date of the denial.   The applicant may appeal the denial by submitting written correspondence to the Chief of Police which should include any information the appellant wishes to have considered.

After the appeal has been reviewed, the appellant will receive a written response from the Chief of Police containing the final decision.  Within 60 days after a denial of the application, the applicant may file a separate application with the Los Angeles County Sheriff’s Department, attaching a copy of the denial letter from the Chief of Police.  The Sheriff will exercise independent discretion in granting or denying licenses to these applicants.
